These terms and conditions along with our Terms of Website Use, Delivery Policy and Refunds Policy state information about us while constituting the legal terms and conditions, (‘Terms’) in which we sell any of the goods (‘Goods’) listed on our website (and all related pages) (‘Site’) to you.

 

www.cladybybedat.com is operated by Bedat & Co GENEVE. Every reference to “we”, “us”, “Bedat & Co”, “bedat.com” or similar terminologies are as an indication to this entity.

 

Proceeding with purchase from us is a form of an agreement to the Terms & Conditions set; it is the consumer’s responsibility entirely to ensure being completely aware of the inclusive.

 

1. Our Contract

 

1.1 You will be guided through the necessary steps in placing your order with us. You are allowed to check and amend any errors before submitting your order form to us. Kindly take the time to read well and crosscheck your order at each stage of the order process. Alternatively, you may request for a member of our customer service team to place an order on your behalf.

 

1.2 Upon placement of your order, you will receive three emails from us.

 

1.2.1 “Order Confirmation”

Affirming your order is being processed by our system

 

(When your order is submitted and you receive an “Order Confirmation” from us, this does not mean that we have accepted your order, it only means that the order has been successfully received into our system. Following “Order Confirmation”, we will undertake validity and verification checks.)

 

1.2.2 “Pick Up Notification”

Informing that your item has been ‘picked’ from stock and allocated to your respective order, at which point your card will be charged

 

(Subject to receiving clear results from the validity and verification checks after “Order Confirmation”, a contract will come into existence between you and us where we will provide you with an email to confirm the above - “Pick Up Notification”)

 

1.2.3 “Tracking Number”

Containing a tracking number, for you to be able to use in monitoring the delivery status of your Goods online.

 

 

1.3 You will be assigned an order number to your order and this will be brought to your attention in the “Order Confirmation.” Please be sure to quote the order number in all subsequent correspondence with us in relation to your order.

 

1.4 Should your order not be accepted, you would receive an email from us. This is normally due to the following reasons:

 

1.4.1 Unavailability of Goods

 

1.4.2 Authorization of your payment is unobtainable

 

1.4.3 Requested delivery date cannot be met

 

1.4.4 Security check failure

 

1.4.5 Error in pricing or description of Goods

 

1.5 In the case we are not able to deliver you the Goods , for example because the Goods are not in stock or no longer available, we will inform you of this through email and we will not process your order.  If you have already paid for the Goods, we will refund you the full amount as soon as possible.

 

1.6 The images of the Goods on our website are for illustrative purposes only. Despite our best attempt in displaying the products with extreme precision, we cannot guarantee that your device’s display will reflect the Goods as accurately. Therefore, the Goods delivered to you may faintly contrast from the images shown.

 

2. Price

 

2.1.1 The price of the Goods will be as shown on our website at the time we confirm your order. Our prices do not include any added tax. VAT is charged to all shipping locations, with the exception of places where local VAT is charged. For other destinations, where no VAT is due, the price you pay remains the same as stated.

2.1.2 TAXES

Please note that you may be subject to import duties and taxes, which are collected when the shipment reaches your delivery address. You will be responsible for payment of such import duties and taxes. It should be noted that Bedat & Co has no control over these charges and, since these charges are different for different countries, Bedat & Co cannot predict their amount. We advises you to contact your local customs office for further information.

 

2.2 Delivery charges are on a separate note and free of service (not incorporated in the price of Goods), which will be highlighted during the checkout process prior to confirming your order.

 

2.3 All promotional pricing or deals are subject to availability and may be withdrawn at any given time.

 

Incorrect Pricing

 

2.4 During the stages of entering relevant information onto the system, we have taken fair measures to ascertain that the prices are correct at the time.  Nevertheless, it is still possible for some of the Goods to be priced incorrectly. Bearing this in mind, our dispatch procedures comprise re-checking prices.

2.4.1 For Goods (actual value) priced lesser than the price stated on our Site, we would charge the lower amount when dispatching the Goods to you

 

2.4.2 For Goods (actual value) priced higher than the price stated on our site, we will contact you at soonest to inform you of this error and provide you the option of moving forward with purchase at the correct pricing or cancelling your order. Until further instructions from you, we will not process your order. Should we be unable to contact you with your contact details provided during the time of making your order, we will treat the order as cancelled and notify you of this in written.  If the pricing error is obvious and unmistakable while could have been reasonably recognized to be a mispricing by you, we do not have to provide the Goods to you at the incorrect (lower) price.

 

3. Payment

 

3.1 We accept most common forms of electronic payment including but not limited to VISA, MasterCard, American Express, Maestro, and PayPal. Any charges for payments by credit card will be added to the total order amount and alerted to you before you place an order.

 

3.2 Payment is taken from your card when the Goods are dispatched to you. When using PayPal to pay, your payment may be instant and so, we will be unable to delay this until the time of dispatch. 

 

3.3 All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery. We may also need to use extra security steps through Verified by Visa, Mastercard®SecureCode or American Express SafeKey.

 

3.4 We reserve the right to reject a payment or an order of which we find to be risky and could be associated with fraudulent. In this case, the price will be refunded using the same payment method while you will be contacted and offered the options of paying by other means or to cancel your order.

 

4. Delivery Of Goods

 

Although we try our best to ensure packages are delivered in a timely manner, shipping times will adjust depending on the destination. Once a package is shipped, we have no control over the duration it will take to arrive. It is also not in our hands should your package be delayed by your country’s customs office. Through placing an order with us, you accept the risk of your package being delayed during shipment for reasons like as mentioned. 5. Your Rights To Cancel

 

5.1 You have a right to cancel an order during the period described in condition 5.2. This means that during the period, if you decide to change your mind or no longer wish to hold the product, you should notify us in order to cancel the order and send you back a refund.

 

5.2. Your right to cancel starts from the date of the Order Confirmation (when the contract between us is formed) Your right to cancel starts from the date of the Order Confirmation (when the contract between us is formed) and ends 14 days later.

 

5.3 If the Goods have been delivered to you before you decide to cancel your order then you must immediately return the Goods to us without any delay in accordance to our Return Policy.

 

5.4 Provided you cancel your order in accord with this condition (5), subject to compliance with our Return Policy, we will refund you the full price paid for the Goods within 14 days from when you inform us of your decision to cancel the contract or 14 days from the date we receive the Goods back from you (whichever comes first.)

 

6. Our Right To Cancel

 

6.1 We may cancel an order at any time prior to delivery for any reason. This includes for an Event Outside Our Control as defined within condition 12, or the unavailability of stock. Should this happen, we will promptly contact you.

 

6.2 If we have to cancel an order in accordance with condition 6.1 once you have paid for the Goods, we will refund the payment to you.

 

7. Faulty Goods

 

7.1 If the Goods are faulty, you must return the Goods in accordance with condition 5.3. Subject to the terms of the manufacturer’s warranty, you may be entitled to a replacement of the Goods or a refund in accordance with condition 5.4. 

 

7.2 Goods that are faulty or not as described, you have legal rights in relation to. These legal rights are not affected by your right of return or refund in this condition (7) or anything else in these Terms & Conditions.

 

8. Privacy

 

8.1 Bedat & Co, FedEx(whom are responsible for delivery of Goods) only stores essential information to make a purchase and process your order.  We do NOT store your credit card details and it is always processed across a secure server, using our online payment provider. We do not sell or lease any of your personal information.

 

9. Security

 

When placing an order, your Internet protocol address is logged for reasons of fraud protection. Before all orders are shipped, they are scanned strictly for fraud by our fraud department. Your order may take longer should you specify a different shipping address to your billing address, as we will need to perform the necessary checks. Upon legal request, the appropriate authorities will be disclosed of fraudulent or suspicious orders.

 

10. Our Right To Vary These Terms

 

10.1 From time to time, we amend these Terms & Conditions. Please see the bottom of this page to find the last update.

 

10.2 Each time you place an order for Goods from us, the Terms & Conditions enforced at the time of your order will apply to the contract between you and us.

 

10.3 Should we have to revise these Terms & Conditions as they apply to your order, we will contact you to give you a heads-up notice of the changes taking place and direct you on how to cancel your order if you are not pleased with the alterations.

 

11. Our Liability

 

11.1 If we fail to comply with these Terms & Conditions, we are accountable for the loss or damage you suffer that is a foreseeable result of our breach in Terms & Conditions or our negligence. However, any loss or damage that is not foreseeable will not be our responsibility. Foreseeable loss or damage is if it is an obvious consequence of our breach or if you and we contemplated it at the time we entered into the contract.

 

11.2 The Goods we supply are only for domestic or private use. You agree not to use the Goods for any commercial, business or re-sale purpose, and we shall have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

11.3 Our liability does not exclude or limit in any way the following: 

 

11.3.1 Death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors

 

11.3.2 Fraud or fraudulent misrepresentation

 

11.3.3 Any matter in respect of which it would be unlawful for us to exclude or restrict liability

 

12. Events Outside Our Control

 

12.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms & Conditions that is caused by an Event Outside Our Control.

 

12.2 An Event Out of Our Control means any act or event beyond our reasonable control, including without limitation change of law, strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, failure of public or private telecommunications networks.

 

12.3 Should an Event Outside Our Control take place, which affects the performance of our obligations under these Terms & Conditions: 

 

12.3.1 You will be contacted as soon as possible.

 

12.3.2 Our obligations under these Terms & Conditions will be suspended     and the time for performance of our obligations will be extended during 

the course duration of the Event Outside Our Control. In situations where     the Event Outside Our Control affects our delivery of Goods to you, we 

will arrange a new delivery date with you once the Event Outside Our 

Control has ended.

 

12.4 You may cancel the contract if an Event Out of Our Control takes place and you no longer intend on us providing our Goods to you.

 

13. Other Important Terms

 

13.1 From the moment Goods are delivered, risk of loss and damage of the Goods is assumed to be by you.

 

13.2 Your rights or our obligations under these Terms & Conditions will not be affected should we transfer our rights and obligations under these Terms & Conditions to another organization. You will always be notified through us posting on this Site if so.

 

13.3 You are only able to transfer your rights or your obligations under these Terms & Conditions to another person if we agree upon it in writing.

 

13.4 This Contract is strictly between you and us. No other person shall have any rights to enforce any of its Terms & Conditions.

 

13.5 Each of the statuses in these Terms & Conditions operates separately. Should a court or relevant authority decide that any of them is unlawful or unenforceable, the remaining paragraphs will still stay in full force and effect. 

 

13.6 You are to comply with your obligations under these Terms & Conditions regardless of our failure to insist that you perform any of your obligations under these Terms & Conditions, enforcing our rights against you, or delay in doing so as it does not mean we have waived our rights against you. If we do waive a default by you, we will only do so via writing and it does not automatically carry forth to waive any later default by you.

 

13.7 These Terms & Conditions, along with our current prices and delivery details set out the whole of our agreement in relation to the supply of Goods from us to you. Nothing said by any sales person on our behalf should be understood as a variation of these Terms & Conditions or as an authorized representation about the nature or quality of any Goods offered for sale by us. To be safe from fraud or fraudulent misrepresentation, we shall have no liability for any such untrue or misleading depiction.

 

13.8 These Terms & Conditions are governed by the English law and the parties agree that any claim or dispute (including non-contractual claims or disputes) which arise with regards to these Terms & Conditions or any contract will have exclusive jurisdiction by the courts of England.

DELIVERY POLICY

 

1. Delivery Notifications

 

When your order has been dispatched, you will receive an email at the address you have specified. This email contains the tracking number (if applicable) so you can track it online right to your doorstep. You may also choose to have a delivery confirmation sent to your mobile phone via text message. 

 

2. Delivery Timescales

 

The delivery time is between 3 to 15 working days depending on your location.

Bedat & Co does not currently open on bank and public holidays. Orders received on these days will be dispatched the next working day with the delivery timescales as above. 

Due to the nature of the watches and jewellery which Bedat & Co sell, Bedat & Co operates a strict fraud screening process and therefore, Bedat & Co is only able to offer this next-day service if the order is validated by our network easily. (e.g. it is being delivered to the billing address registered to the card, or it is being delivered to a known company, or you have used your card before and have no bad history). In almost all cases, this is a straightforward process and can be completed immediately. 

If this is not the case (e.g. you specify an alternative residential address as the delivery location which resides in another county to the billing address) there may be a delay of a few hours while Bedat & Co perform the appropriate checks. If Bedat & Co is unable to validate your order; you will receive an email to inform you of this and what the next steps are. 

In the event of a delay, Bedat & Co will contact you either by email or telephone to let you know. 

While the vast majority of locations are valid for next day delivery, there are a few remote locations that are not covered by the next day delivery service.

3. Postage Method

All orders qualify for free delivery, which is usually FedEx International Priority. This means your item will usually be delivered the working day after dispatch. 

4. Delivery To Business Addresses And Multiple Occupation Buildings

Bedat & Co GENEVE allows delivery to alternate delivery addresses including business addresses and places of work. If you do specify a business address for delivery, please ensure that there will be someone available during normal working hours (e.g. at reception who can sign for delivery on your behalf as FedEx delivers to the address and not necessarily to the named person.) 
Please note that in a multiple occupation building, anyone in the building is allowed to sign the parcel to confirm its receipt. FedEx considers an item as delivered once a signature at the designated address is achieved. It is your responsibility to ensure that the recipient is at the delivery address, or to obtain the delivered parcel from the signatory. 


5. Signature Upon Delivery, Missed Deliveries And Denial Of Receipt 


Due to security reasons, items delivered require a signature. Parcels shipped cannot be left without signatures. If you miss the delivery person, a card will be left to give you instructions to either arrange a redelivery or to collect it from your local sorting office / delivery depot. 
If for any reason the item is returned to us (e.g. incorrect address specified, item not called for), Bedat & Co will inform you immediately by email as soon as we receive the item. From this point forth, you will be given a choice whether you wish us to re-dispatch the item or for you to cancel the order. If further to dispatch it is undelivered again, we reserve the right to charge delivery charges for subsequent deliveries. Please note that for items that were undelivered through fault of the consumer and a refund is requested, Bedat & Co reserve the right to deduct our outwardly shipping fees from the refund total.

In the case of a parcel being signed for and a delivery confirmation being available on the courier's website, if the customer denies receiving the package, this is called a ‘Denial of Receipt’. Under these circumstances, we must contact FedEx to confirm the delivery details, who will in turn contact the customer to ask for written documentation to be completed to confirm that the parcel has not been received. These circumstances must be mediated by the delivery service and we cannot take action until it has been confirmed whether or not the customer received the parcel. 

6. Inspection Upon Delivery 

When receiving your order, you should inspect the packaging to ensure that it has not been tampered with in any way. If it does appear to be tampered with, you should refuse the delivery.

7. Late Deliveries Or Dispatch 

Although Bedat & Co is able to ship almost every order in the specified delivery timescale, in rare circumstances our shipping capacity can be exceeded and cause a delay of one extra day. Bedat & Co regrets that this situation can arise occasionally, and is an unfortunate event that is naturally associated with buying online. However, this happens rather infrequently and should it, your order is marked for urgent delivery the following day. 

Another factor that may cause a delay is when the delivery service itself has a problem. This, again, is an irregular state but is unfortunately beyond our control. In such a condition, Bedat & Co will do our very best to take responsibility for the situation and ensure that your order is delivered as quickly as possible. 

8. Compensation For Late Deliveries 

If a delivery is late (e.g. the postal service fails to deliver within the guaranteed timescale,) Bedat & Co does not provide any compensation since the delivery is free. Compensation will also not be provided to cover consequential losses (e.g. time taken off work to receive deliveries/the item is intended as a gift, or you purchase the same item from a more expensive retailer.) 

9. Lost Deliveries 

Bedat & Co uses FedEx for all of our deliveries due to reasons of reliability and convenience. Unfortunately, as with all delivery services, there are unusual settings where parcels do not arrive in the agreed timescale or they are lost completely. Under these contexts, we endeavor to ensure that the item is delivered to you as soon as possible by contacting the delivery service, attempting to locate your parcel and have it delivered. You may also contact the delivery service yourself with the tracking number supplied to you in your dispatch email. In the instance of lost items, we cannot refund orders or send out a replacement until the delivery is confirmed to be lost. This must be confirmed by the delivery service itself, and the time period at which items can be confirmed lost is 10 working days. 

RETURNS POLICY

 

At Bedat & Co Geneve, we make all efforts to describe and display every product as realistically as possible. We also understand that sometimes the items you receive are not quite as you expect it to be, and therefore we are proud to offer you 14 days to change your mind on any of your purchases from this website. Your right to cancel starts from the date you receive your Order Confirmation and ends 14 days later. Further details regarding your rights to return items can be found by accessing our Terms and Conditions of sale. 

Conditions for the return of items 

The item(s) must be in unworn and in the same condition in which they were received. Items must be returned with all the original packaging, instructions, guarantee and any extras. 

Engraved C.Lady by Bedat & Co products cannot be returned to Bedat & Co for exchange or refund.

 

If a visual defect is found with the item(s) upon arrival, you must notify us within 48 hours. 

Certain watches require adjustment to ensure good fit. Please refer to our bracelet adjustment policyat the following link to maintain your refund eligibility.

How to return items 

Items must be returned using a trusted courier service. Delivery charges are to be paid by you in returning the Goods to us.

Refunds 

When we receive the item, our returns department will confirm that everything is present and in its original condition to ensure its eligibility for refund. We process refunds as rapidly as possible and you will receive an email to notify you when the refund has been processed. We process most refunds on the same day which they were received, but please allow up to a maximum of 14 days for the money to reach your account. It does not usually take this long, but can happen at times for reasons such as bank delays or errors. 

Faulty Items 

Faulty items must be returned using the same process described above. For further details regarding your rights in relation to faulty goods, please refer to our Terms and Conditions of sale.

Should you have not received or misplaced your returns form; return the item to us with a covering note stating your invoice number. 

Exchanges 

If you wish to exchange a purchase for another item, please just return your undesired item for a refund and order a new item. 

WARRANTY

Warranty terms: Two year from the date of purchase.
This warranty covers manufacturing defects on the watch itself (movement, case, crystal). Other parts than the above are not covered by this warranty. To have replacement covered under this warranty performed, please use our contact form on the "contact us" page. In the e-mail you need to specify your name, address, order number and a detailed description of the issue. Finally, write ‘reclaim of purchase’ as subject of the e-mail or letter. Return shipping is paid by customers. If Bedat & Co cannot find any defects described above, the product will be sent back to the customer.

Note that repair/replacements will be charged in the following cases, even during the warranty term.

  • Failure or damage caused by improper use or carelessness (knocks, dents, crushing, broken crystal, etc.)

  • Failure or damage caused by unjustifiable repair or modification.

  • Failure or damage caused by fire or water, or a natural disaster such as for example an earthquake.

  • Esthetical changes that occur during normal wear and tear and aging (minor scratches, etc.; on the case and/or crystal, alteration of the colour on the wristband and the peeling of the plating).

  • In case the retail store and the purchase date are not indicated on the warranty, or if this information has been rewritten.

  • If the warranty is not submitted along with the watch.

  • Battery replacement will be charged even during the warranty term.

The case, dial, hands, crystal, watchband or other parts thereof may be replaced with substitutes if the originals are not available.

This warranty warrants that you can receive free replacement in accordance with the terms set forth herein and within the specified term, and shall not restrict any lawful right of the Customer.

USER CONTENT

The www.cladybybedat.com website may include user generated content, for example social media applications. Bedat & Cº does not claim any ownership in rights in such content (images, photos and videos etc.) and take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise is offended by such content, please contact our customer service.

RETENTION OF TITLE

All products remain in Bedat & Cº Genève property until full payment is made.

FRAUD

All frauds are reported to the authorities and Bedat & Cº Genève reserves the right to cancel the purchase if any suspicion is raised.

Bedat & Cº may revise these terms & conditions from time to time. Every time you order a product from us, the general conditions in force at that time will apply to the contract between you and Bedat & Cº. You should therefore periodically visit this page to review the then current terms to which you are bound.
